Lincoln Park Sexual Assault Warrant - WCPO has just received the warrant in this case. The charging decision and arraignment are not expected today.

Theodore Wafer - The Michigan Court of Appeals affirmed the Second Degree Murder and Involuntary Manslaughter convictions. However, the court remanded the case for a Crosby hearing.*

*On a Crosby remand, the sentencing court should first allow the defendant an opportunity to inform the court that he or she will not seek resentencing. If notification is not received in a timely manner, the court (1) should obtain the views of counsel in some form, (2) may but is not required to hold a hearing on the matter, and (3) need not have the defendant present when it decides whether to resentence the defendant, but (4) must have the defendant present, as required by law, if it decides to resentence the defendant. In determining whether the court would have imposed a materially different sentence but for the unconstitutional constraint, the court should consider only the circumstances existing at the time of the original sentence. See United States. v. Crosby, 397 F3rd 03 (CA 2, 2005).

Curry Bryson - Defendant charged in connection with the August 3, 2015, fatal shooting of a threeyear-old son of a friend, by the defendant's 11-year-old son. Today a jury found Bryson guilty of Involuntary Manslaughter and Felony Firearm. The jury acquitted him a count of Child Abuse Second Degree. He was remanded to jail pending the sentencing on April 20, 2016 at 9:00 a.m.

Lincoln Park Sexual Assault - The case has been decided, but the warrant will not be signed by the judge until tomorrow morning. We will release the name of the defendant at 9:00 a.m. tomorrow. We have been informed that the arraignment will take place at 9:30 a.m. in 25th District Court in Lincoln Park.

Two Men Charged in Lincoln Park Sexual Assault Case

Prosecutor Kym Worthy has charged Fernando DeLon Anderson, 24 (DOB: 10/6/91), of Detroit, and Fernando Delon Anderson, 19 (DOB: 2/15/97), of Lincoln Park, have been charged in connection with the kidnapping and sexual assault of a 23-year-old Detroit woman. The two men are cousins. On March 30, 2016 at 11:05 p.m., it is alleged that the defendants approached the woman in the 1700 block of Southfield in Lincoln Park while she was in her car, and got in. Once inside the car, she was directed to drive to a dead end street in Detroit while 24-year-old Defendant Anderson displayed a handgun and gave her instructions. It is alleged that she was sexually assaulted by both defendants. After the assault, the defendants made her drive back Lincoln Park, took her cell phone and left the area. The victim contacted the Lincoln Park police and their investigation led to the identification of the two defendants.

They have each been charged with three counts of Criminal Sexual Conduct First Degree, Armed Robbery, Kidnapping and Felony Firearm. Defendant Anderson, who is 24-years old, has also been charged with Felony in Possession of a Firearm.

Both defendants have been arraigned in 25th District Court in Lincoln Park. The probable cause conference is scheduled for April 19, 2016 at 9:00 a.m.; the preliminary examination is scheduled for April 26, 2016 at 11:00 a.m. before Judge Clifton in 25th District Court. Both defendants received a $500,000 cash/surety bond.

Woman Charged in Fatal Car Crash Killing Upper Peninsula Man

Prosecutor Kym Worthy has charged Shayla Deneice Tucker, 33 (DOB: 12/27/82), of Detroit, in connection with a fatal car crash that occurred at Michigan and Trumbull in Detroit. On April 2, 2016 at approximately 1:00 a.m., it is alleged that Tucker was driving her car west on Michigan Avenue at an excessive speed when she had a collision with another car that struck and killed Paul Pesola, 35, of Pelkie, Michigan. The impact caused the victim to be thrown over an eight foot fence into the former Tiger Stadium grounds. The victim was pronounced dead at the scene by a medic. Tucker was transported to a local hospital for treatment and taken into custody.

Tucker has been charged with Reckless Driving Causing Death (15 years). The defendant was arraigned on Friday, April 8, 2016. The Probable Cause Conference is scheduled for April 15, 2016 at 8:30 a.m.; the Preliminary Examination is scheduled for April 20, 2016 at 1:30 p.m. Both hearings are before 36th District Court Judge Deborah Langston. The defendant received a $150,000/10% bond.
