WAYNE
COUNTY'S ORDINANCE FOR EVALUATION AND MAINTENANCE
IMPORTANT
IF YOU ARE SELLING YOUR HOME
A Properly
Functioning Septic System Will:
- Help protect
and enhance the quality of the county's surface and groundwater
resources.
- Protect public
health from disease causing organisms and nusiance conditions.
- Properly dispose
of your wastewater.
- Preserve the
county's waterways for recreational enjoyment.
Studies have
shown that approximately 20% of all septic systems exist in a
state of failure.
The Wayne County
Commission and the Wayne County Executive, recoginizing this have
adopted County Ordinance 99-527. Currently,
this ordinance is effective in the Rouge-River water shed communities
of Wayne County. those communities are:
Allen
Park, Canton Township, Dearborn, Dearborn Heights, Garden City,
Inkster, Livonia, Northville, Northville Township, Plymouth
Township, Plymouth, Redford Township, Romulus, Wayne, Westland,
and Van Buren Township.
Beginning
in September of 2003, this ordinance will become effective County-Wide

You Are Required To:
- Maintain your
disposal system to prevent failure.
- Notify the
health department of any known or suspected disposal system failure.
- Remedy any
disposal system failure.
If
You Are Selling Your Home
You Must:
- Have your
disposal system evaluated by a registered evaluator.
- Cooperate with
the registered evaluator by providing pertinent information and
paying the costs for the evaluation.
- Obtain an
authorization for sale or transfer prior to closing from the
Wayne County Health Department Division of Environmental Health.
If
Your Home Is Vacant:
Please Contact the Wayne County Division
of Environmental Health Your
disposal system evaluation may be delayed.
A Septic System
Evaluation Includes:
- Identification of
your septic tank and drainfield locations.
- Pumping out
of your septic tank at the time of evaluation.
- Exposing the
drainfield for inspection.
- Determining if
your disposal system is functioning satisfactorily, is in a state
of failure or contains potential failure conditions.
- The Evaluation may
also identify recommendations which may prevent premature failure
of your disposal system.
- Educational materials
are provided as part of the evaluation.

REPORTS Reports Are Prepared After All Evaluations
- A disposal
system evaluation report must be provided to the owner within 10 days
of the evaluation.
- The registered
evaluator must also send the report to the health department
within 10 days of evaluation and at least 5 days
prior to closing.
- Disposal
system Evaluation Reports are maintained by the Wayne County
Division of Environmental Health and are available to prospective
buyers or any other interested persons.
- Reports are
valid for 6 months.
If Your System
Fails:
- Corrective
action is required.
- You will be
contacted by the Health Department with instructions on how to
bring your system failure into compliance.
- You may still
close on the sale or transfer, however, assurance
must be given that corrective action will be completed.

and,
- If a sanitary
sewer is available a connection must be made.

Agent Must:
- Present evidence
to a prospective buyer of any disposal system failure and any
remediation action necessary or completed.
- Notify the
health department and the buyer when there is a closing without
an evaluation because the home was vacant.
- Inform the
seller that a disposal system evaluation is required prior to
sale.

Wayne County
Health Department Division Of Environmental Health Is Responsible For:
- Administering the
On-Site Sewage Disposal System Evaluation and Maintenance Ordinance.
- Maintaining a
database of disposal systems in Wayne County.
- Maintaining a
filing system for all sewage disposal system permits and evaluation
records.
- Maintaining a
list of registered evaluators.
· The Wayne County Health Department is also available to
perform disposal system
evaluations.
- Requiring and
enforcing remediation where there is evidence of disposal system
failure.
