Board Of Determination Information


The Board of Determination Meeting:
  • A petition was filed by residents of the Drainage District.

  • A Petition is a formal process by which residents or municipalities may initiate the process to have a drain improved.

  • The valid petition was filed with the Wayne County Drain Commissioner’s Office which requires a meeting to be held to determine if there is a project needed to solve the drainage issues along the Drain. This meeting is known as the Board of Determination.

Testimony Information:
  • Testimony will be received by the Board of Determination.

  • In order to assure that all who wish to speak are given an opportunity and to keep an accurate record, it is requested that each individual wanting to testify complete a Testimony Card.

  • The Testimony Cards will be available at the meeting.

  • Written testimony can be presented by giving it to the Board.

The Board’s Role:
  • The Board of Determination’s role is to make the following three decisions: 1) Whether the project is necessary; 2) Whether a portion of the cost is to be assessed at-large to the municipalities; and from time to time 3) Whether it is necessary to add lands to the Drainage District.

  • The Board of Determination does not decide: 1) The scope of the project; 2) The cost of the project; or, 3) How much property owners and municipalities are assessed for the project.

Minutes of the Meeting:
  • Minutes of the Board of Determination will be available at the Drain Commissioner’s Field Office located at 3501 Henry Ruff Road Westland, Michigan 48186.

Appeal:
  • Any person feeling aggrieved by the determination of necessity or no necessity may seek judicial review by filing an action in Wayne County Circuit Court within ten (10) days after the determination by the Board.
