Diversion Section - Drug Offense Delayed Sentence Program

The Wayne County Prosecutor's Office Drug Offense Delayed Sentence Program (DODS) was created as an alternative for drug offenders who did not qualify for the 3rd Circuit Court's Drug Court. DODS offers an individual who has never been convicted of a felony an opportunity to avoid a criminal record.

The Drug Offense Delayed Sentence program is geared toward first time offenders with a narcotic related charge. The Defendant enters a guilty plea and the Court delays sentence for eleven (11) months. The case can ultimately be dismissed if the defendant complies with certain conditions designed to improve ones quality of life and reduce the likelihood of a repeat offense.

The DODS program requires a defendant to complete high school or a GED program, obtain and maintain employment, participate in random urinalysis, complete drug treatment, complete 40 hours of community service, attend monthly mentor meetings at the Wayne County Prosecutor's Office, report to a Probation Agent remain crime free and pay costs and fees associated with the case. This program is staffed by one Assistant Prosecuting Attorney.
