Yesterday Judge King granted defendant's request for a stay in proceedings based upon his filing a delayed application for leave to the Michigan Court of Appeals over the prosecution's objection.

Today the prosecution's Emergency Motion Compel Judge King to enter the bind over order was before Judge Timothy Kenny. Judge Kenny ruled that the court rules only allow WCPO to file an application for leave to appeal Judge King's order staying the case pending appeal and the case was blind drawn to Judge Shannon Walker. Judge Walker gave the defense until Monday, February 9, 2015 to file a response and set the matter over until Feb 25, 2015 at 9:00 a.m. for her ruling. It does not appear that there will be argument by the parties on that day.
