Joseph Weekley* - Detroit Police Officer charged in connection with the fatal shooting death of Aiyana Stanley-Jones in her home during a DPD police raid. Today Judge Cynthia Hathaway granted the defense request to dismiss the Involuntary Manslaughter charge on a directed verdict motion. The charge of Careless Discharge Causing Injury or Death remains before the jury. The prosecution has requested a stay to appeal the ruling that was granted by the court today. Because the jury trial is in progress no further comment will be made about the matter. The judge has instructed the jury to return to court on Monday, October 6, 2014.

On October 3, 2014 WCPO has filed an Application for Leave to File Emergency Interlocutory Appeal with the Michigan Court of Appeals. Late on October 3, 2014 the Michigan Court of Appeals (MCA) ordered that the WCPO leave to appeal would be held in abeyance pending the Court's review of the pleading. The MCA also entered a stay of the jury trial proceedings pending a resolution of the appeal or further order of the court. Those interested in receiving a copy of the WCPO pleading will need to contact the Michigan Court of Appeals.

Today the Michigan Court of Appeals denied WCPO's application for leave to appeal. See Order attached. Today WCPO will be filing an Emergency Motion for Reconsideration with the Michigan Court of Appeals.

Romulus Police Corruption Case - Today Defendant Richard Balzer, pleaded no contest to One Count of Embezzlement by a Public Official and Misconduct in Office; all other counts were dismissed in return for the plea. Donald Hopkins and Richard Landry pleaded no contest to one count of Embezzlement by a Public Official, all other counts were dismissed in return for the plea. Balzer, Hopkins and Landry will have their restitution determined and will lose their certification to be employed as police officers. All three defendants will be sentenced on October 29, 2014 at 9:00 a.m. before Judge Michael Hathaway.

Jayru Campbell - Cass Tech High football player accused of assaulting his girlfriend. His preliminary examination will resume before Judge Ruth Carter tomorrow at 1:30 p.m. There are no court appearances for him today.

Father Timothy Kane -  Detroit Catholic priest convicted by a jury as charged of: Continuing Criminal Enterprise, Using a Computer to Commit a Crime, Uttering and Publishing, Conspiring to Commit Uttering and Publishing, Embezzlement from a Charitable Institution, and Conspiracy to Embezzle from a Charitable Institution for taking money from an Archdiocese of Detroit charity fund created to assist people in need. His sentence date is on December 12, 2014 at 9:00 a.m. before Judge Bruce Morrow.

The jury began deliberations today on the charge of Careless Reckless Discharge of a Firearm only. They will return tomorrow to continue deliberations at 9:00 a.m.

Judge Hathaway declared a mistrial due to a hung jury on the charge of Careless Reckless Discharge. The court has set the date of November 21, 2014 at 9:00 a.m. to return to court. The decision regarding how the prosecution will proceed will be placed on the record at the next court date.
