Elementary Student Charged with Bringing
Loaded Weapon to School
On December 5, 2018, at approximately 2:40 p.m., a 10-year-old (DOB: 02/17/2008) Detroit student of Spain Middle School is alleged to have concealed a loaded handgun in his book bag. A fellow student observed the weapon and immediately reported it to school authorities. The gun was confiscated from the child without incident. The school is located in the 3700 block of Beaubien in Detroit.
The 10-year-old has been charged as a juvenile with Carrying a Concealed Weapon and Possession of a Weapon in a Weapon Free School Zone.* He is under the jurisdiction of the juvenile court, and is not subject to adult penalties for the charges. Other aspects of the case remain under investigation.
A Preliminary Hearing was held today at the Juvenile Detention Facility located at 1326 St. Antoine Street in Detroit before Referee Leslie Graves. A $5,000 personal bond was ordered. A Pre-Trial Hearing is scheduled for 1:30 p.m. on Monday, January 7, 2019 before Referee Mona Youssef at the Lincoln Hall of Justice. As a condition of bond, the youth may not have access to any firearms or weapons. He must comply with the expulsion from school, and may not be on any school property until authorized to do so by school authorities.
*The charges are allegations and defendants are presumed innocent until and unless proven guilty.
