Comerica Park Food Handler Charged for Spitting on Pizza

Prosecutor Kym Worthy has charged Jaylon Juwan Kerley, 20 (DOB: 10/18/1997), of Roseville, MI, in connection with spitting on pizza dough he was preparing while working at a concession stand in Comerica Park. On September 21, 2018, it is alleged that Kerley spat on a pizza he was preparing and covered his saliva with pizza sauce. The incident was captured on video and reported to the police by the head of security at Comerica Park. On September 23, 2018, Detroit police officers arrested Kerley. He was terminated from his employment as a result of the incident.

Kerley has been charged with one count of Food Law Violations, MCL 289.5107(2), a four-year felony, and one count of Food Law Violations, MCL 289.5107(1), a 90 day misdemeanor.* He was arraigned this morning in 36th District Court before Magistrate Millicent Sherman. The Probable Cause Conference is scheduled for October 3, 2018 at 8:30 a.m.; the Preliminary Examination is scheduled for October 10, 2018 at 9:00 a.m. Both hearings are before Judge Lydia Nance-Adams in 36th District court. The defendant received a $100,000/10% bond.

Prosecutor Worthy said: "The allegation in this case is disturbing on so many levels. Yesterday I literally refused to order food. We all want to make sure all food that we order is clean, safe, germ-free, and unadulterated with any substance that should not be there."

*The charges are allegations and defendants are presumed innocent until and unless proven guilty.
