Defendant David Hammond was charged with Second Degree Arson (20 years), Felonious Assault (4 years), and Aggravated Domestic Violence (1-year Misdemeanor). The crimes were allegedly committed between September 20 and September 25, 2020. The victim, Ms. Andrea Tucker's was the ex-girlfriend of Defendant Hammond at that time.

The preliminary examination in Defendant Hammond's case was held on November 3, 2021, before Judge Kenneth King. Defendant Hammond was bound over on Arson, Domestic Violence and Felonious Assault. The Court also added a count of Home invasion First Degree at the conclusion of the proceedings. The original bond given by a judge at the arraignment on the warrant was a $7500 personal bond with a no contact order, was continued after the exam. No bond violations, including an alleged tire slashing incident, were mentioned by the victim or the police to the Assistant Prosecuting Attorney (APA) at that time.

On November 12, 2021, the officer in charge (OIC) of the case contacted the Assistant Prosecuting Attorney (APA) who had conducted the preliminary examination and advised that the victim, Ms. Tucker, had several Ring videos of a man in her yard. The OIC said that the person in the videos could not be identified because his face was hidden by a hood, but that Ms. Tucker believed it was Defendant Hammond. The OIC did not say it was an emergency.

The APA said that he would look at the video, but the identification issue would make a bond motion difficult. The APA did not advise a supervisor or the arraignment prosecutor about the videos, as a result, no bond motion was filed prior to the arraignment on the warrant that was held on November 17, 2021 via Zoom before Judge Gregory Bill.

Ms. Tucker was fatally shot on November 17, 2021, and her homicide is currently being investigated. No comment will be made regarding this investigation. On Thursday, November 18, 2021, DPD informed WCPO that the defendant was taken into custody.

Today, an emergency motion was argued before Judge Gregory Bill. The Court remanded Defendant Hammond to jail pending a bond hearing scheduled for Monday, Friday, November 22, 2021, at 10:30 a.m.
